In a sort of follow up to SafeWork v L&N Properties, Think Tank who were another PCBU onsite were sentenced.
Whilst it is a seperate case, it is the same incident that L&N properties were sentenced for and a pretty similar culpability. For that reason I would suggest reading the L&N Article.
On 1 December 2023 Judge Strathdee issued orders ending the matter of SafeWork NSW v Think Tank Building Solutions Pty Ltd [2023] NSWDC 532.
SafeWork NSW were represented by Barrister Malcolm Scott and Think Tank were represented by Barrister Maurice Baroni.
They were ordered to pay $216,000 + Costs as they were not able to plead poor unlike L&N Properties (who would have been ordered to pay $390,000 instead of their $100,000 fine).
